Our caseloads increasingly deal with the resolution of conflicts arising out of shortages rather than abundance. Losses of investments or jobs, downturns in real estate, mishandling of assets, foreclosures, and family disputes in response to recent financial crises make up a significant share of our work as mediators and lawyers. These times call for new approaches to mediation – from the retention of the mediator to the evaluation of offers through the analysis of likely legal outcomes to the hovering specter of bankruptcy. This interactive program will explore the many ways in which the recession has transformed conflict resolution, offering practical insights and techniques that can be integrated into mediation. It is suitable for both mediators and advocates and will feature subject matter experts and seasoned mediators.
