Have you ever settled a case but been bothered by a choice you made or a tactic you used while mediating? As attorney mediators, we grapple with ethical dilemmas during mediation more often than we might expect. At what point is a mediator “practicing law” or “giving legal advice” during a discussion of the legal risks of a case? Is it ever alright to lie about information in caucus? Do you owe any duty – to either the party, the attorney or the Bar – if you discover that malpractice may have been committed? Come join a lively discussion of what it means to each of us and the Model Standards of Conduct and California Rules of Professional Conduct to mediate in an ethical manner. Reflect upon and discuss ethical challenges that have arisen or may arise in your practice area.Please provide your own lunch – no charge to attend.
