As mediators, we know how to help parties settle, but even when the case is settled, parties often continue to feel mistrustful and hostile towards each other. While this is common, it is not inevitable. It is possible for parties to achieve a greater degree of resolution through forgiveness.
Forgiveness is the ultimate tool of conflict resolution, giving parties unparalleled opportunities to repair relationships and achieve closure. The panel will provide an overview of the role forgiveness can play in mediation and practice pointers, such as when and how to talk to clients about forgiveness.
Dr. Fred Luskin, one of the world’s leading experts and teachers about the power of forgiveness, will talk about his pioneering work and why forgiveness matters in legal disputes. He will be joined by Eileen Barker, a lawyer/mediator who has been teaching forgiveness for the past ten years, Marin Superior Court Judge Roy Chernus, who will share his perspective from the bench as to the immense value of forgiveness in legal disputes, and Barbara Monty who will talk about how forgiveness can enable mediators and litigators to achieve better results for their clients.
Dr. Fred Luskin, renowned forgiveness expert, is the Director and CoFounder of the Stanford University Forgiveness Project and author of the ground-breaking best-seller, Forgive for Good: A Proven Prescription for Health and Happiness. His work has been used in teaching forgiveness around the word, and has been empirically validated through randomized clinical trials.
Eileen Barker is an attorney/mediator and leader in the movement to integrate emotional healing and forgiveness in conflict resolution. She is the Founder of The Forgiveness Training Institute for lawyers and mediations, an international forgiveness teacher and coach. In 2016, she was named Champion of Forgiveness along with Archbishop Desmond Tutu and Nelson Mandela.
Hon. Roy Chernus Marin Superior Court, has been with the Court since 2006. Previously, he was Executive Director for Legal Aid of Marin. He has received numerous awards including YMCA of San Francisco Volunteer of the Year for his work with Marin Youth Court, the Martin Luther King, Jr. Humanitarian Award, and Marin County Lawyer of the Year.
Barbara Monty is a trial attorney and mediator with Monty White LLP, and she is training to become a forgiveness coach. For over 30 years, Barbara has mediated a wide variety of disputes including corporate fraud and gang violence. She has been recognized for her pioneering work in preventing elder abuse and has mediated disputes for the Human Rights Commission.
